The Federal government in its 2012 budget has made changes to the category of qualified donee called ?Gifts to Certain Charitable Organizations Outside Canada?. There are currently 9 foreign charities that are in a list ?Gifts to Certain Charitable Organizations Outside Canada?.? The CRA information circular describes these organizations at: http://www.cra-arc.gc.ca/E/pub/tp/ic84-3r6/README.html? FInance is proposing to modify the rules to allow the CRA in consultation with Finance to recognize such organizations only if they are ?? related to disaster relief or urgent humanitarian aid; or ? in the national interest of Canada.?? This is a narrowing of the categoy - however, I think that having clarity will be helpful for CRA and it is possible that this category could have a large number of reputable international groups that are invovled with disaster relief and urgent humanitarian aid added over the next few years.? Furthermore, the category ?in the national interest of Canada? may apply to other groups such as those involved with international development (that is not disaster relief or urgent humanitarian aid) or other groups for example dealing with health care. Time will tell but there is a significant category of foreign prescribed universities and perhaps in a few years there will be a few dozen foreign charities added to the ?Gifts to Certain Charitable Organizations Outside Canada? list.? Keep in mind that Canadians have already a lot of choice when it comes to international programs and over 5200 Canadian charities spent funds outside of Canada.? So there is no shortage of places to donate if you want to make this world a better place.?

So essentially the CRA may designate, in consultation with Finance, a foreign organization for a 24-month period from when the Federal government has made a gift to the foreign organization, if
(i) the foreign organization is a charitable organization that is not resident in Canada,
(ii) CRA is satisfied that the foreign organization is (A) carrying on relief activities in response to a disaster, (B) providing urgent humanitarian aid, or (C) carrying on activities in the national interest of Canada, and
(iii) the foreign organization has applied to the Minister for designation under this subsection.

Organizations will have to apply for this status - presumably CRA will ask for information necessary to satisfy itself that the organization should be provided with such status.? Also this status can only be conferred after both CRA and Finance have given the go-ahead.

On page 435 of the Budget Finance notes:

?Gifts to Foreign Charitable Organizations
In general, donations made by Canadians to foreign charities are not eligible for the Charitable Donations Tax Credit or Deduction. However, a foreign charitable organization that receives a gift from the Government of Canada may register as a qualified donee under the Income Tax Act. As a qualified
donee, a foreign charitable organization may issue an official donation receipt for a gift received from a Canadian donor, entitling the donor to a credit or deduction in computing Canadian income or tax. A Canadian registered charity may also make a gift to a foreign charitable organization that is a
qualified donee.

Budget 2012 proposes to modify the rules for registering certain foreign charitable organizations as qualified donees. Foreign charitable organizations that receive a gift from the Government may apply for qualified donee status if they pursue activities:
? related to disaster relief or urgent humanitarian aid; or
? in the national interest of Canada.

After consultation with the Minister of Finance, the Minister of National Revenue will have the discretionary power to grant qualified donee status to a foreign charitable organization that meets these criteria. Qualified donee status will be made public, and will be granted for a 24-month period that
begins on the date chosen by the Minister of National Revenue, which normally would be no later than the date of the gift from the Government. Granting qualified donee status in these situations will ensure that Canadians receive tax relief for donations made to approved foreign charitable
organizations that carry out activities of significance to, and in the interest of, the Canadian public. The Canada Revenue Agency will develop guidance regarding the administration of this measure.

Foreign charitable organizations that have received qualified donee status under the existing rules will continue to be qualified donees until the expiration of the period of their current status.

This measure will apply to applications made by foreign charitable organizations on or after the later of January 1, 2013 and Royal Assent to the enacting legislation.?

Gifts to Foreign Charitable Organizations (p. 475)

(42) That, for applications made by a foreign organization on or after the later of January 1, 2013 and the date of Royal Assent to the enacting legislation,
(a) subparagraph (a)(v) of the definition ?qualified donee? in subsection 149.1(1) of the Act be replaced with the following:
(v) a foreign organization designated under subsection 149.1(26), and
(b) section 149.1 of the Act be amended by adding the following after subsection 149.1(25):
Designated foreign charitable organizations
(26) For the purposes of the definition ?qualified donee? in subsection (1),
(a) the Minister may designate, in consultation with the Minister of Finance, a foreign organization for a 24-month period that includes the time at which Her Majesty in right of Canada has made a gift to the foreign organization, if
(i) the foreign organization is a charitable organization that is not resident in Canada,
(ii) the Minister is satisfied that the foreign organization is
(A) carrying on relief activities in response to a disaster,
(B) providing urgent humanitarian aid, or
(C) carrying on activities in the national interest of Canada, and
(iii) the foreign organization has applied to the Minister for designation under this subsection; and
(b) a foreign organization designated under paragraph (a) is deemed to have been registered by the Minister at the beginning of the 24-month period.

1. What is the current status under the Income Tax Act of certain charitable organizations outside Canada to which Her Majesty in the Right of Canada has made a gift?
Charitable organizations outside Canada to which Her Majesty in Right of Canada has made a gift enjoy the same ?qualified donee? status as registered charities, meaning they can issue official donation receipts for gifts that then allow donors to claim tax relief and as qualified donees they can receive funds from registered charities.

2. What are the new requirements for certain charitable organizations outside Canada to which Her Majesty in the Right of Canada has made a gift?
Budget 2011 proposes that these organizations be on a publicly available list maintained by the CRA in order to continue to be recognized as qualified donees. These organizations will also be required to keep books and records supporting any official donation receipts they issue, and provide these to CRA upon request.

3. What are the consequences if such an organization does not comply with these rules?

If a charitable organization outside Canada to which Her Majesty in the Right of Canada has made a gift fails to keep books and records supporting any official donation receipts it issues, and to provide these to CRA upon request, or is involved in the improper issuance of donation receipts, the CRA may suspend its receipting privileges or revoke its qualified donee status.

4. What are the requirements to be considered a qualified donee as a charitable organization outside Canada to which Her Majesty in right of Canada has made a gift?
To be considered a qualified donee as an organization outside Canada to which Her Majesty in right of Canada has made a gift, the federal department that made the payment, or the recipient organization itself, should forward the following information to the Charities Directorate, Canada Revenue Agency:
?a copy of the governing document of the foreign entity;
?a description of the foreign entity?s activities;
?a copy of the letter or certificate issued by the foreign authority granting the foreign entity charitable status;
?copies of correspondence, agreements, or other documents related to the Crown gift; and
?proof that the gift has been made (for example a copy of the cheque).

The Charities Directorate will then consider whether the foreign entity qualifies based on a two-part test. First, the organization must demonstrate that it was the recipient of a gift. Second, the organization must demonstrate that it would meet the requirements for registration as a charitable organization in Canada.

5. Is there a current list of these organizations?
Yes. The CRA Charities Directorate maintains a list of these organizations. It can be found through the Charities-related forms and publications pages.

Once the Charities Directorate has determined whether a gift has been made and whether the foreign organization would meet the registration requirements, it will provide written confirmation of its decision. If the organization meets the two-part test, its name will be added to the CRA?s public list.

6. Are books and records required to be kept in Canada?
No. These organizations may keep their books and records in their own jurisdiction but must make them available in Canada at the request of the CRA.

7. When do these new rules apply?
The rules will apply on or after the later of January 1, 2012, and Royal Assent of the implementing legislation. During the interim period, these organizations will continue to be eligible for qualified donee status based on the current rules.

New study shows birth weight may identify future metabolic risk in girls

Chevy Chase, MD Heavier female babies are more likely to develop diabetes and related metabolic risks when they grow up compared with their male counterparts, according to a recent study accepted for publication in The Endocrine Society's Journal of Clinical Endocrinology and Metabolism (JCEM).

The incidence of early onset type 2 diabetes has been rising in stride with the epidemic of childhood obesity. Previous studies have shown that cardiovascular risk factors in childhood and adults are associated with birth weight. This study investigated the associations between birth weight and body fat distribution in early childhood with future metabolic risk factors such as obesity, insulin resistance and high blood pressure.

"What happens to a baby in the womb affects future heart disease and diabetes risk when the child grows up," said Rae-Chi Huang, MD, PhD, of The University of Western Australia in Perth and the study's lead author. "We found that female babies are particularly prone to this increased risk and females who are at high risk of obesity and diabetes-related conditions at age 17 are showing increased obesity as early as 12 months of age."

In this study, researchers examined 1,053 17-year-olds from an Australian birth cohort. Follow-up of study participants took place at eight intervals between one and 17 years of age. In addition to birth weight and BMI, researchers took measurements of blood pressure and levels of insulin, blood glucose, triglycerides and cholesterol. The 17 year old girls with the greater waist circumference, triglycerides, insulin, and lower HDL-cholesterol (good cholesterol) were also heavier from birth with consistently higher BMI thereafter. In contrast, birth weight had no statistical impact on metabolic risk factors in males.

"These findings are significant because in our modern western society, we are seeing increased maternal obesity and gestational diabetes, which means there will also be a rise in female newborns that are born large for their age," said Huang. "Our results can be applied to public health messages targeting both maternal health and measures in early infancy regarding the prevention of childhood obesity and its consequences."

Other researchers working on the study include: Trevor Mori, Sally Burrows, Chi Le Ha, Wendy Oddy, Carly Herbison, and Lawrence Beilin of The University of Western Australia; and Beth Hands of Notre Dame University in Western Australia.

WASHINGTON (AP) ? An outside group with ties to conservative causes on Thursday launched a $3.6 million ad buy lashing out at President Barack Obama's energy record, blaming him for rising gas prices and his decision to delay the Keystone XL pipeline project.

The ads aired in eight states by the American Energy Alliance seek to undercut Obama's message that he has increased oil drilling and pushed to develop renewable energy sources, and came as the president unsuccessfully pressured Congress to cut billions of dollars in subsidies for oil companies.

The ad, called "Nine dollar gas," says gas prices have nearly doubled on Obama's watch and criticizes his opposition to oil drilling in Alaska, his effort to block the Keystone XL pipeline and the administration's decision to provide more than $500 million in federal loans to solar company Solyndra, which later went bankrupt.

It also places a spotlight on Energy Secretary Steven Chu, quoting him from a 2008 interview as saying that the nation needs to "boost the price of gasoline to levels in Europe." ''That's $9 a gallon," the ad says. Chu is then shown saying he doesn't own a car.

"Tell Obama: We can't afford his failing energy policies," the ad concludes.

The ads are running in New Mexico, Colorado, Nevada, Iowa, Florida, Ohio, Virginia, and Michigan, all states crucial to the 2012 presidential campaign.

Democrats called the American Energy Alliance a "front group for big oil," and released an ad on the Web that highlighted common Obama themes on energy: increased oil production, decisions to require carmakers to raise gas mileage standards and more renewable energy.

Obama has argued his case on energy in recent weeks, traveling to a solar plant in Nevada, oil fields in New Mexico and the site of a future pipeline in Oklahoma. On Thursday, he urged Congress to end the oil subsidies, saying the "oil industry is just fine" and no longer needs "taxpayer giveaways." The Senate rejected the plan.

Chu has since renounced his statement, saying at a recent House hearing that he has tried to reduce gas prices as energy secretary.

The American Energy Alliance's president is Thomas Pyle, a former lobbyist for Koch Industries. The industrial firm's top executives are Charles and David Koch, who have been prominent supporters of conservative causes.

You know your way around the data centre. Your staff respect you and it?s largely safe to walk among the users without fear of assault. By industry standards, you run a tight ship. However, a couple of things are niggling you, writes Ade McCormack:
?You rarely get involved in strategic business decisions.
?The chief executive still calls you first when their laptop is broken.

Where does this leave your career?

The reason you are not included in strategic business decision-making is for much the same reason the catering manager is not invited to board meetings. You are both seen as operationally important, but not strategically significant.

Despite the wisdom you will have accrued as to how technologies can and do change business models for the better, you cannot get the senior management team?s attention.

In fact, the last time you tried, the chief finance officer looked at you as if you were a supermarket check-out assistant offering lifestyle and wealth management advice. You are seen as first-line support ? a view reinforced by the fact that more IT elements can now be bought in packaged form, which means the amount of software development has dropped considerably. The creative aspects of IT are disappearing and what remains are the handle-turning procedural elements of IT management.

The ?cloud? ? aka the internet ? is taking this to the extreme, enabling users, in effect, to hire a virtualised IT function via the web. So it would appear that the writing is on the wall for IT managers.

This is not totally true, however. Some aspects of your in-house portfolio of IT services do not lend themselves to a cloud-based model. Cloud vendors might focus on services that deliver the greatest financial return and so will avoid niche, complex or legacy systems ? these will remain your responsibility.

But overall, the bad news is that end-user IT departments are dying. The good news is, of course, that IT departments are dying. Because it?s not about technology management any more. Users don?t want technology per se, they want what technology can give them, ie information, knowledge and even wisdom.

While it might be a few years before I can convince the market to talk about the IT industry morphing to the IKW (Information, Knowledge, Wisdom) industry, I believe this is what is happening. The interesting end of the digital services world is becoming the provision of technologies that help people make better decisions through better business intelligence (sweat the database) and effective collaborative tools (sweat the staff).

Smart IT managers with genuine CIO aspirations are thus advised to take the following steps:
?Decouple yourself from technology. By all means let people know you are digitally alert, but suppress tech jargon when talking to the users.
?Express all request and reporting in terms of the organisation?s strategic imperatives.
?Embrace the cloud. The sooner you outsource technology management the sooner you can focus on value-adding information and collaboration services.
?Pay great attention to your brand. Read up on brand management.
?Build credibility with the users by taking a sabbatical on the user side. A stint in sales or finance will equip you with the skills needed not just to be on the senior management team, but one day to lead it.
?You know you are intelligent. In fact you know you can reason someone to death if necessary. But possibly your intelligence is more IQ than emotional intelligence. Consider whether you need to work on your softer side.
?If you are going to become a senior player in the organisation, you need to ensure that you have the political skills to remain a senior player. Forming alliances with the powerful starts with knowing who the powerful are and what they see of value in you.
?Treat your IT function as if you were a customer. This again positions you as a consumer of IT services rather than a provider. Your focus is on innovative ways to lever information to achieve strategic objectives.
?Look for land grab opportunities that extend your influence. You could become chief energy officer, chief property officer, and chief business process officer, to name a few.

Mindlessly applying for CIO roles would be akin to following your fellow lemmings off a cliff. Be aware that organisations need their CIOs to be leaders. As someone moving up through the ranks you can steer your personal development in a manner that meets the need of employers today and tomorrow. In a post industrial digital economy, we need information leaders rather than IT managers.

Video shows handcuffed FL shooter Zimmerman

SANFORD, Fla. (AP) ? A security video shot after the slaying of Trayvon Martin shows admitted shooter George Zimmerman being led in handcuffs from a police car, and an attorney for the teen's family said it is obvious to him that Zimmerman did not have injuries to his face and head as his supporters have asserted.

Sanford police Sgt. David Morgenstern on Wednesday confirmed that the video being shown by ABC News is of Zimmerman. The 28-year-old's head and face are visible throughout and he is dressed in a red and black fleece jacket. Police are shown frisking Zimmerman whose hands were handcuffed behind his back. They then lead him into a building.

Zimmerman said that on Feb. 26 he was pursuing the 17-year-old Martin, who was not armed, because the teen was acting suspiciously. He said he lost sight of the black teenager and Martin attacked him as he headed back to his sport utility vehicle. Zimmerman's father is white and his mother is Hispanic.

The neighborhood watch volunteer told police he fired in self-defense and he was not arrested, touching off widespread public outrage and protests across the country. Zimmerman's attorney, Craig Sonner, has said in more than one interview that his client's nose was broken during the fight with Martin.

The Orlando Sentinel, citing anonymous sources, has reported that Martin grabbed Zimmerman's head and banged it several times against the sidewalk. A statement from Sanford police said the newspaper's story was "consistent" with evidence turned over to prosecutors.

Sonner said the gash on the back of Zimmerman's head probably was serious enough for stitches, but he waited too long for treatment so the wound was already healing. Miguel Meza, who identified himself as Zimmerman's cousin, said Zimmerman was in "the fight of his life."

"This certainly doesn't look like a man who police said had his nose broken and his head repeatedly smashed into the sidewalk," Ben Crump, an attorney for Martin's family, said in a statement. "George Zimmerman has no apparent injuries in this video, which dramatically contradicts his version of the events of February 26."

Sonner did not immediately return an after-hours call to his office.

Crump called the video "riveting" and "icing on the cake" that Zimmerman should be held accountable for what happened.

Since the shooting, Zimmerman's supporters say he's gone into hiding and that he and his family have gotten death threats.

Martin's supporters, including a host of outspoken celebrities and civil rights leaders who have appeared on television for the past two weeks, don't believe Zimmerman's story. They want him arrested and prosecuted.

LAKELAND, Fla. -- Florida's Medicaid program must cover applied behavioral analysis for children who are diagnosed with autism and related disorders, a federal judge in Miami ruled Monday morning.

An estimated 8,500 Florida children on Medicaid are identified now as having full-blown autism or related conditions falling under the umbrella of autism spectrum disorder. The decision will benefit them, along with other children diagnosed with those disorders in the future who need behavioral health therapy.

The post-Hurricane Katrina New Orleans planning and design work of James Dart, AIA, university lecturer and director of the Siena Urban Design Studio at NJIT's College of Architecture and Design (COAD) is featured in a new book that examines the roles and responsibilities of architects in disaster recovery. Edited by Marie J. Aquilino, Beyond Shelter: Architecture + Human Dignity (Metropolis Books, New York, NY) features 20 generously illustrated reports from the field written by the founders of some of the world's most provocative architecture and engineering firms and studios; accomplished nonprofits and research centers; and leaders of such prominent organizations as the Red Cross, UN-Habitat and the World Wildlife Fund who are on the frontlines of disaster prevention and recovery.

Dart is principal of the New York-based design firm DARCH. In 2005-2007, he participated in a community-based planning and design project for New Orleans East funded by HUD with the Pratt Institute in partnership with the Association for Community Design and COAD.

Along with Associate Professor of Architecture Darius Sollohub and many dedicated NJIT architecture students, Dart, a New Orleans native, was active in planning and design efforts in the aftermath of Hurricane Katrina. With collaborator Deborah Gans, he placed third in the High Density on the High Ground international competition sponsored by Architectural Record and Tulane University.

DARCH has won numerous local and national awards including a 2002 Honor Award from the American Institute of Architects. Current work includes multiyear projects at Bartram's Garden in Philadelphia, the nation's oldest botanical garden; the Wyckoff Farmhouse Museum, Brooklyn, New York; master planning for Temple University's Ambler, Pennsylvania, campus; new facilities for the Paul Taylor Dance Company in New York; and private residences throughout the United States.
